1. General provisions

These terms and conditions govern the legal relationship arising between the ArtVertigo online shop (hereinafter the Shop) and the customer (hereinafter the Customer) when purchasing works. The Shop is operated by ArtVertigo OÜ, located at Pikk jalg 3-6a, Kesklinna linnaosa, Tallinn, email artvertigogallery@gmail.com.

In addition to these terms, the purchase of works is governed by the laws in force in the Republic of Estonia. ArtVertigo OÜ reserves the right to amend these terms. Any changes will be published on this page and do not apply retroactively to contracts already concluded.

2. Products

The works sold in the Shop are original paintings created by hand by the artist. Each work is unique. As these are handmade original works, colour tones and texture may vary depending on the light and on your screen settings. The dimensions, materials and other relevant information for each work are provided alongside the product.

3. Prices

All prices are shown in euros and include VAT. Shipping costs are added to the purchase price and displayed to the Customer before the order is confirmed. The Shop reserves the right to change prices. If a price has been changed after the Customer has placed an order, the price in force at the moment the order was placed shall apply.

4. Placing an order

To place an order, add the desired work to the basket and fill in the required details. Before confirming the order, we ask the Customer to ensure the accuracy of the information provided, as the Shop is not responsible for delays or failed delivery caused by incorrect details.

The contract is deemed concluded from the moment the order amount has been received in the Shop's bank account. Once the order is confirmed, the Shop sends a confirmation to the Customer's email address.

5. Payment

An order can be paid for through the payment methods offered in the Shop — by bank link, card payment or by bank transfer against an invoice. Payments are processed through a secure payment environment, and the Shop has no access to the Customer's payment instrument details.

6. Delivery of the work

Works are packed carefully and securely for transport to ensure they arrive intact. Paintings are sent to the Customer via a trusted courier service. Delivery takes place after payment has been received in the Shop's bank account.

• delivery within Estonia generally takes 3–7 business days;
• international delivery times are agreed separately with the Customer;
• large-format works are delivered under special arrangements, agreed with the Customer where necessary.

Delivery times are estimates and are not binding. The Shop is not responsible for delays caused by the courier service, but will make every reasonable effort to ensure the order reaches the Customer on time.

7. Handover and inspection of the work

We ask the Customer to check the integrity of the packaging on receiving the work. If the packaging is visibly damaged in transit, please note this in the presence of the courier and notify the Shop immediately by email, attaching photos where possible. This helps us resolve any damage more quickly.

8. Right of withdrawal

A Customer who is a consumer has the right to withdraw from a contract concluded in the online shop within 14 days of receiving the work, without giving a reason. To exercise the right of withdrawal, an unequivocal withdrawal request must be sent to the email address artvertigogallery@gmail.com.

The right of withdrawal does not apply where the Customer is a legal person. The right of withdrawal may also be limited or excluded for commissioned works made to the Customer's order and created according to the Customer's personal wishes (pursuant to § 53(4) of the Law of Obligations Act). The Customer's attention is drawn to this before a commission is placed.

9. Returning a work

• The work must be returned no later than 14 days from submitting the withdrawal request.
• The returned work must be undamaged and in its original packaging. We ask that the work be packed as carefully as it was sent to the Customer.
• The Customer is liable for any diminution in the value of the work if it has been used in a manner other than what is necessary to establish its nature and characteristics.
• The cost of returning the work is borne by the Customer, except where the work proved to be defective or did not correspond to the order.

The Shop will refund all payments received under the contract, including the original delivery cost, within 14 days of receiving the withdrawal request. The Shop has the right to withhold the refund until the Customer has returned the work or provided proof that it has been sent back.

10. Defective works and submitting complaints

If a work that reaches the Customer has a defect for which the Shop is responsible, the Customer has the right to demand repair, replacement, or withdrawal from the contract. As each work is a unique original, replacement may not always be possible — in such cases, the most suitable solution will be agreed with the Customer.

A complaint can be submitted to the email address artvertigogallery@gmail.com. The Shop will respond to the complaint at the earliest opportunity, but no later than 14 days from receiving it.

11. Liability

The Shop is not liable for any damage incurred by the Customer that results from incorrect details provided by the Customer, improper handling of the work after handover, or circumstances beyond the Shop's control (force majeure).

12. Processing of personal data

The Shop processes the Customer's personal data in accordance with the privacy policy, which you can read here.

13. Resolving disputes

Disputes arising between the Customer and the Shop are resolved through negotiation. If no agreement is reached, the Customer has the right to turn to the Consumer Disputes Committee (Consumer Protection and Technical Regulatory Authority) or to the courts. A consumer may also submit a complaint through the European Union's online dispute resolution platform.
